WORK PERMIT EVALUATION

WORK PERMIT EVALUATION CRITERIA REQUIRED TO BE FULFILLED BY APPLICANT COMPANIES AND FOREIGNERS
1. It is obligatory to have at least 5 Turkish citizens employed in the workplace that requests the work permit. If the person who needs the permit is the company partner, then the obligation for 5 people’s employment is requested for the last 6 months of the 1-year work permit given by the Ministry. In case of work permit applications for more than 1-foreign employee for the same workplace, then for each foreign employee, there should be 5 Turkish citizens working in the workplace.

2. The workplace’s paid capital must be at least 100,000TL or its gross sales must be at least 800,000TL or last years’ export amount must be at least $250,000.

Article 2 will not be applied in the evaluation of the applications of the foreigners who will work in associations and foundations. Article 1 and 2 will not be applied in the evaluation of the applications of the foreigners who will work in Turkish representatives of Foreign State Airways, education sector and home services.

3. The company partner who applies for the work permit must have at least 20% of the capital which should not be less than 40,000TL.
​
4. The monthly wage that is declared to the foreigner by the employer should be consistent with the position and qualities of the foreigner. According to this, the least wage that can be paid to the foreigner (taking Minimum Wage amount on the application date) is;
a- 6.5 times the Minimum Wage for the engineers and architects which request a prior
b- 4 times the Minimum Wage for engineers, architects and the unit and branch managers
c- 3 times the Minimum Wage for the foreigners who will work in jobs that need expertise and proficiency and teachers
d- 1.5 times the Minimum Wage for the foreigners who will work in and other jobs (as sales person, marketing-export person),for home services the salary must be equal to the minimum wage
e-2 times the minimum wage for foreigners who will work in acrobat and similar titles in tourism-animation organization companies and foreigners who will work in jobs such as masseur, masseuse and SPA therapist

5. The tourism establishments which contain authorized massage rooms and are at least 4 stars and holiday camps’ request masseur, SPA therapist will be taken into consideration.
6. For foreigners to be employed in services requiring expertise and competence within the context of services of entertainment sector firms and tourism-animation organization companies; if at least 10 T.R. citizens are employed, then quota for employing five T.R. citizens separately for each foreigner will not be applied.

7. While evaluating work permit requests of foreigners in such cases specifically determined by bilateral and multilateral contracts signed by Turkey, and of foreigners to be employed on the basis of purchase of goods and services by public institutions and organizations according to contract and tender procedures; criteria stated in Articles 1 and 2 shall not be applied.

8. In case of works requiring state-of-art technologies or absence of a Turkish expert with the same skills, then criteria stated in Articles 1 and 2 shall not be applied upon the approval of General Directorate.

9. For Featured Companies Fulfilling the Conditions of Direct Foreign Investment, number of T.R. citizen employers in all offices of company across the country shall be taken as basis for the application of criteria stated in Article 1 with regard to foreigners to be employed except the key personnel.
